Family Law

The solicitors and staff of DJ Hinton Lawyers understand that the breakdown of a relationship, whether a marriage or defacto relationship, can be one of the most difficult and emotional times in a person’s life.  Our firm provides assistance and support to all family law clients to get through this difficult time and to achieve the best possible outcome.  Our family law team, headed by principal David Hinton in Hervey Bay and associate Meaghan Smyth in Caloundra have a thorough working knowledge of this specialised area of law, including all aspects of financial matters, children’s matters, child and spouse maintenance and divorce.

David Hinton has been helping clients who have experienced relationship breakdown and separation with their family law matters since 1989, and undertook his training with Michael Bauman, now a judge of the Family Court of Australia.  David is assisted in our Caloundra office by solicitor Meaghan Smyth who has been practicing almost exclusively in family law since 2005. Our solicitors are supported by experienced paralegals who are used to dealing with clients going through the turmoil of a relationship breakdown.

We are able to assist our clients in all aspects of family and defacto law matters, from property division to children’s issues, divorce to spousal maintenance, defacto disputes to same sex couple disputes, child custody and child maintenance, relocation disputes (including international relocation) and many more. We are also experienced in drafting and advising on Binding Financial Agreements, including Prenuptial Agreements. We treat all clients with compassion and respect, and do our best to achieve the best possible outcome for each client.

Our preference is always to attempt to resolve every family law matter by negotiation, and our family law solicitors have an excellent record of resolving the majority of their matters by negotiated agreement.  However, if a matter cannot be resolved through negotiation, our family law team will fight hard to achieve the best possible outcome for each and every client, and in appropriate cases will also seek to recover legal costs from the other party.

If you have separated from your partner or spouse, or even if you have not separated but you have some concerns or questions, please feel free to contact us at either our Hervey Bay or Sunshine Coast office.  We offer a free initial consultation for up to 30 minutes to assist clients in obtaining some initial advice and direction for their particular circumstances.  Thereafter we offer competitive rates for all ongoing matters, and we are prepared in appropriate cases to defer payment of our fees until the matter is concluded (conditions and charges apply).
