David Hinton

Solicitor  |
Hervey Bay
David is the principal of DJ Hinton Lawyers and brings with him more than 25 years’ experience as a solicitor at leading firms on the Gold Coast, Brisbane CBD, Mackay and most recently in Hervey Bay and Maryborough.

David has extensive experience in all aspects of family law, insurance and TPD claims, will disputes and estate litigation.  David has lived in Hervey Bay since 1998 with his family including wife Helen and children Jeremy and Piper.  David recently decided to start his own firm in order to achieve his goal of providing expert legal advice and assistance to clients by concentrating on the areas of law in which he is experienced.

David graduated from the Queensland University of Technology in 1988 with a Bachelor of Laws degree and was admitted as a solicitor of the Supreme Court of Queensland in April 1991. He also became a solicitor of the High Court of Australia in the same year.  Prior to his admission as a solicitor David undertook articles of clerkship (traineeship) with then prominent Gold Coast solicitor Michael Baumann, who is now a Senior Judge of the Federal Circuit Court of Australia.  It was there that David developed a passion for the law, and in particular for family law and also for assisting clients who had suffered loss and damage through the negligence of others.  David has continued to practise in his chosen areas since commencing his professional career, which has enabled him to gain significant experience in all aspects of his chosen areas of practise.  In addition to practising in personal compensation law and family law David has also had extensive experience in all areas of general civil and commercial litigation and dispute resolution.  More recently David has also developed an interest and experience in all aspects of will and estate disputes including claims for further and better provision against estates (both on behalf of executors and claimants) and also contested Wills.

David’s experience in family law includes all areas of family law, with a particular emphasis on financial matters both large and small, simple and complex.  David’s desire is to assist all family law clients to achieve a reasonable and realistic outcome as cost effectively as possible.  David is fully aware of the substantial emotional and financial cost which family law proceedings has on clients and their families, and David’s emphasis is always on exploring every possible avenue to resolve matters by negotiation.  However if a matter cannot be resolved amicably David will fight hard to ensure his clients receive the best possible outcome.  David has an exceptional record of achieving results for clients at trial that are better than what the clients were prepared to settle their matters for prior to Court proceedings.

David also has extensive experience in all aspects of personal compensation and insurance law, including TPD (total and permanent disablement) claims.  In addition to acting for claimants David also has 10 years’ experience acting for defendants and insurers. Through that work David has a unique insight into how defendants and insurers operate in these types of claims, which is unique for the Hervey Bay region.  This assists David in achieving the best possible outcome for his clients.

Outside of work David is very involved in the community.  In particular David has been a member of the Rotary Club of Hervey Bay Sunrise since 2000 and has held several board positions including President, Secretary and Director. He is currently the District Legal Officer for his Rotary District (District 9570). David is very proud to have been instrumental in introducing to Hervey Bay and Maryborough the Rotary Youth Driver Awareness Program for year 11 school students.  David is also involved in other local groups which assist local charities and persons in need, including the “Friday Lunch Bunch” and “Hervey Bay Crocs”, and most recently David enjoyed participating in the “Duna Derby” which is a local car rally raising funds for seriously ill local children and their families.  David is an avid sports fan who follows almost every sport, but is particularly interested in rugby league, rugby union, AFL, cricket and tennis.  More recently David has become interested in triathlons.  David is a passionate supporter of his children who are both very actively involved in numerous sporting activities including triathlon.  David is also a Director of the Hervey Bay Boat Club, and has been a director since 2010.

David is a member of the Queensland Law Society, and is also a member of the Queensland Family Law Practitioners Association (FLPA) and the Australian Lawyers Alliance.
